DatMap Platform — Moderation, Statement of Reasons & Appeals Policy

This policy is issued by DatMap, LLC, a Delaware limited liability company ("DatMap", "we", "us"), and describes how we moderate content on the DatMap Platform, how you can report content, what information we provide when we take a moderation action, and how to appeal. It supplements, and is incorporated into, our Terms of Service (https://datmap.ai/legal/terms) and our Submission & Contribution Terms (https://datmap.ai/legal/submission-terms). Where this policy grants procedural rights required by the EU Digital Services Act (Regulation (EU) 2022/2065, the "DSA"), those rights apply as required by law; we extend the same procedures to all users as a matter of good practice wherever reasonably possible.
1. What this policy covers
This policy applies to user-provided content on the Platform, including Submissions, Published Content, public maps, and other content you make available to others. It does not apply to private Customer Data in your own tenant space, which is not published to others and is governed by the Terms of Service and Privacy Policy.
2. Our content standards
The content rules are set out in Section 9 (Prohibited Content) of the Submission & Contribution Terms and Section 7 (Acceptable Use) of the Terms of Service. In short, content must not be illegal, infringing, defamatory, harassing, fraudulent, deceptive, or malicious; must not contain malware; must not include personal data you have no right to disclose; and must be content you are authorized to provide.
3. How we moderate
3.1 Review. Submissions to public maps are reviewed before or after publication at our discretion. We use human review, supported by automated tools (for example, spam, malware, and duplicate detection). No moderation decision that restricts your content or account is made solely by automated means without the possibility of human review on appeal.
3.2 Actions we may take. Depending on severity, we may: decline to publish a Submission; edit it for format or clarity; truncate or re-categorize it; remove or demote Published Content; restrict a feature; suspend or terminate submission privileges or an account; or, where required, report content to authorities.
3.3 Discretion. Publication is at our discretion and is not an endorsement of accuracy. Nothing in this policy obligates us to publish any particular content.
4. Reporting content (notice and action)
4.1 Anyone may report content they believe is illegal or violates our terms by emailing contact@datmap.ai with the subject line "Content Report". To help us act quickly, include: (a) a link to or precise identification of the content; (b) an explanation of why you believe it is illegal or violates our terms (citing the law or term if you can); (c) your name and email address (except for reports concerning certain offenses where the law permits anonymous reporting); and (d) a statement that you believe in good faith that the information in your report is accurate and complete.
4.2 We process reports diligently, non-arbitrarily, and in a timely manner, and we will confirm receipt and notify you of the outcome of your report, including available redress, where the law requires or where practicable.
4.3 Copyright. Copyright-infringement notices under 17 U.S.C. § 512 should instead follow the DMCA process described in Section 10 of the Submission & Contribution Terms (email contact@datmap.ai, subject "DMCA Notice"). DMCA notices and counter-notices are handled under that process.
4.4 Misuse of reporting. Repeatedly submitting manifestly unfounded reports may result in our suspending the processing of your reports, after a warning.
5. Statement of reasons
When we remove, disable, demote, or otherwise restrict your content, or restrict or suspend your account or your ability to submit, we will provide you (at the email associated with your account, or the email given with your Submission) a statement of reasons that includes, as applicable:
- what action we took and its territorial scope, and how long it lasts if temporary;
- the facts and circumstances we relied on, including whether the action followed a third-party report or our own review;
- whether automated means were used in detecting or deciding the matter;
- the contractual term (with a reference to this policy, the Terms of Service, or the Submission & Contribution Terms) or the legal ground we relied on, and why the content or conduct fell under it; and
- your redress options: internal appeal (Section 6), out-of-court dispute settlement where available (Section 7), and judicial remedy.
We are not required to provide a statement of reasons where we do not have your contact details, where the content is deceptive high-volume commercial content (spam), or where a legal order prevents it.
6. Appeals (internal complaint handling)
6.1 You may appeal, free of charge, any decision described in Section 5 — including a decision not to act on a report you submitted — by emailing contact@datmap.ai with the subject line "Moderation Appeal" within six (6) months of the decision. Include the content or decision at issue and why you believe the decision was wrong.
6.2 Appeals are handled diligently and without undue delay, under the supervision of appropriately qualified staff, and are not decided solely by automated means. If your appeal shows the decision was unjustified, we will reverse it without undue delay (for example, by restoring content or reinstating an account).
6.3 We will inform you of the outcome of your appeal with a reasoned response and of the further redress available to you.
7. Out-of-court dispute settlement (EU)
If you are in the European Union and disagree with the outcome of an internal appeal concerning a decision covered by the DSA, you may be entitled to refer the dispute to a certified out-of-court dispute settlement body under Article 21 of the DSA. We will engage with such bodies in good faith as the DSA requires. This option does not affect your right to go to court, and either party retains the right to initiate judicial proceedings at any time. (Dispute resolution for all other matters is governed by Section 15 of the Terms of Service.)
8. Repeat violations
We apply proportionate, graduated measures to repeat violations, up to suspension or termination of submission privileges or accounts, taking into account the frequency and gravity of the violations and the user's intent, and, where the law requires, only after issuing a prior warning. Repeat copyright infringers are handled under Section 10.2 of the Submission & Contribution Terms.
9. Government and legal orders
Where we receive a valid order from a competent authority to act against illegal content or to provide information, we will comply as the law requires and, where legally permitted, inform the affected user of the order and its effect.
10. Transparency
We may publish periodic summary information about our content-moderation activity (such as the number of reports received, actions taken, and appeals resolved) where required by law or as a matter of good practice.

We may update this policy; material changes will be posted here with a new version number and effective date and, where required, notified to affected users.
